Privacy Policy

This policy explains how your personal information is collected and used when you visit thebateleur-sa.com or submit an enquiry through it. It is written to meet our obligations under the Protection of Personal Information Act, 2013 (POPIA).

Who is responsible for your information

Bateleur is a development by Landmark Consortium (Pty) Ltd, registration number 2007/018326/07, of 43 Rivonia Road, Sandhurst, Johannesburg.

We are the responsible party for the personal information described in this policy, because we decide why it is collected and how it is used.

This website is built and run on our behalf by Noldor, who act as our operator under POPIA. They handle enquiries only on our instruction and are required to keep that information secure.

What we collect, and when

When you submit an enquiry, we collect what you enter into the form:

• Your first name and last name
• Your mobile number
• Your email address
• Your indicated purchase budget range
• Your indicated deposit or financing arrangement
• Whether you intend to pay cash, use a bond, or seek full financing
• Whether you are enquiring as an investor or intending to live in the property
• Anything you write in the message field

We also record the web address you arrived from, including any campaign tracking parameters, so we understand which advertising brought you to us.

To prevent automated spam, the form checks how long the page was open before submission and includes a hidden field that people cannot see. This information is used only to identify automated submissions and is not retained.

We do not ask for, and you should not send us, your identity number, banking details or copies of identification through this website.

When you simply browse the site, no account is created and you are not required to identify yourself. See Cookies and analytics below.

Why we use it, and on what basis

We use your enquiry to contact you about Bateleur, answer your question, and where appropriate discuss availability, pricing and the purchase process.

We rely on your consent, given by ticking the consent box when you submit the form. You may withdraw it at any time (see Your rights). We may also rely on the legitimate interests of conducting and marketing our business, where those interests do not override your rights.

Your budget and financing answers help us direct you to appropriate units and put you in touch with the right person. We do not use this information to make any automated decision about you.

Who we share it with

We do not sell your personal information. We share it only as set out here.

We may also disclose information where the law requires it.

Sending your information outside South Africa

Your enquiry is processed and delivered entirely within South Africa. It is sent from infrastructure in Cape Town to a mailbox hosted in Microsoft's South African region, so the enquiry itself does not leave the country. Website analytics is the exception: Google may process that information outside South Africa, as described under Cookies and analytics. Where information does leave the country, we take reasonable steps to ensure it is protected by laws or contractual terms comparable to POPIA.

How long we keep it

We keep enquiries for 36 months from your last contact with us, after which they are deleted or anonymised, unless we are required to keep them longer by law.

Cookies and analytics

We use Google Analytics, delivered through Google Tag Manager, to understand how people find and use this website. It sets two cookies in your browser, _ga and a second beginning _ga_, which distinguish one visitor from another and remember that a visit is continuing. Both expire after two years.

We use this to see, in aggregate:

• Which pages are viewed, and how visitors arrive, including from advertising
• How far down a page people read
• Clicks on links that lead away from this website
• When somebody starts filling in the enquiry form
• Approximate location, at city level, and the device and browser used

We do not use analytics to identify you personally, and the details you type into the enquiry form are not sent to Google. Google processes this information on infrastructure that may sit outside South Africa.

If you would rather not be included, you can block or delete cookies in your browser settings, or install Google'sopt-out browser add-on. The website works normally either way.

The site loads fonts from Google Fonts, an embedded map from Google Maps, and an animation library from a public code repository. These providers may see your IP address as a result. The site also links out to third parties including our interactive price list and BetterBond; those sites have their own privacy policies and this one does not apply to them.

Your rights

Under POPIA you may:

• Ask what personal information we hold about you, and request a copy
• Ask us to correct or delete information that is inaccurate, irrelevant, excessive, out of date or obtained unlawfully
• Object to us using your information
• Withdraw your consent at any time, which does not affect anything done before you withdrew it
• Complain to us, and to the Information Regulator

Security

We take reasonable technical and organisational measures to protect your information, including encrypted connections to this website and restricted access to the systems that hold enquiries. No system is completely secure, and we cannot guarantee absolute security.

Changes to this policy

We may update this policy from time to time. The current version is always published at thebateleur-sa.com/privacy-policy, and the date at the top shows when it last changed.
